In present discourse the courts have said that a 10 Commandments Monument is religious only if it is by itself or they are being used in a secular fashion if they are with other objects within
the same general area. The problem is the 10 Commandments text is an outright religious text, it is the speech of the Abrahamic religions (Judaism, Christianity, and Islam).
Considering that the majority of the people in the United States recognize these 3 subgroups of the Abrahamic religion does not change the fact that even with other historic entities present
it is still religious speech advancing those three religions. In order to justify any secular quality one would have to ask how these 10 Commandments apply to the present US legal system.
The only way to see if when standing alone it has any secular part beyond its religious part is the same way used you analyze the 613 laws in Part 1
The KIng James version of the 10 Commandments are listed below. Those in
Yellow with Green Background
are enforced with present day laws. Those in Red are illegal by todays laws.
Blue is for that if enforced by law would be illegal but can be done by the individual if they so wish.
Gray is reserved for comments.
1.Thou shalt have no other gods before me.
2.Thou shalt not make unto thee any graven image, or any likeness of any thing that is in heaven above, or that is in the earth beneath, or that is in the water under the earth:
Thou shalt not bow down thyself to them, nor serve them: for I the LORD thy God am a jealous God, visiting the iniquity of the fathers upon the children unto the third and fourth generation
of them that hate me; And shewing mercy unto thousands of them that love me, and keep my commandments.
US law has not now or ever allowed the punishment of children for the deeds of their "fathers".
3.Thou shalt not take the name of the LORD thy God in vain; for the LORD will not hold him guiltless that taketh his name in vain.
4.Remember the sabbath day, to keep it holy. Six days shalt thou labour, and do all thy work: But the seventh day is the sabbath of the LORD thy God: in it thou shalt not do any work, thou,
nor thy son, nor thy daughter, thy manservant, nor thy maidservant, nor thy cattle, nor thy stranger that is within thy gates: For in six days the LORD made heaven and earth, the sea,
and all that in them is, and rested the seventh day: wherefore the LORD blessed the sabbath day, and hallowed it.
Slaves are not allowed even though the 10 Commandments endorses slavery.
5.Honour thy father and thy mother: that thy days may be long upon the land which the LORD thy God giveth thee.
6.Thou shaltnot kill.
The government gives law enforcement, executioners, and the military the right to kill. And in the case of the military it is pretty much cart-blanch.
7.Thou shalt not commit adultery.
8.Thou shalt not steal.
9.Thou shalt not bear false witness against thy neighbour.
10.Thou shalt not covet thy neighbour's house, thou shalt not covet thy neighbour's wife, nor his manservant, nor his maidservant, nor his ox, nor his ass,
nor any thing that is thy neighbour's.
Slaves are not allowed even though the 10 Commandments endorses slavery.
2 out of 10 Commandments are illegal for the government to enforce = 20%
5.5 out of 10 You can do but government can't enforce. = 55%
2.5 out of 10 We presently enforce in law. = 25%
So 75% of the 10 Commandments can't be enforced or are illegal.
Since the 10 Commandments is not a crime followed by punishment document in any sense it is thus definitely just a religious document. And although a lot of people that believe in gods use documents like this to encourage
their members to be kind to their fellow man and bow to their god, the problem is this document demands obedience from a god and no matter how you interpret that obedience it is still a demand of obedience from a god
to the extent that the god will do harm to your progeny for 4 generations.
It should be needless to say that the government may not speak against the Constitution of the United States. And considering the First Amendment to the U.S. Constitution requires that the government neither promote
nor prevent someone from practicing religion combined with the fact that the 3 largest religions in the US are the Abrahamic religions which include this document in their beliefs with all of it's inhumane and
unjust promises of harm to the People's progeny is just an indication that it alone in the religious/philosophical statements catagory even with other historic entities is a violation of human rights, religious rights,
and most importantly parental rights to ensure that their children can live a life without the constant threat of some type of eternal hellfire and placing the burdon on those children to beg their parents to worship
this god to protect them from that eternal hellfire.
That being the case simply promoting a single document that threatens retribution for 4 generations should be balanced by other law codes to show no preference by promoting the threat put forward by this document
which by its very words promotes the establishment of this God through the threat of an eternity of hellfire.
In reality different people will interpret different messages differently but the plain English language interpretation of this document leaves no doubt whatsoever about the intent of this God if you do not
bow down to that God. We interpret our laws based on plain language and the same with all of our other documents and there is no reason the Government may have to believe that the wording of this document is anything
more than what it says. The difference here is between words and actions.
If it is just the word you're looking at you can justify whatever you want but if this is the only concept that Government Speech will allow for whatever reason that is action. And deliberate action by the Government contrary to
either or both the Establishment or Free Exercise clauses becomes insurrection because it then is promoting one religion over the other religions within view of many well respected historical objects who's function is to PROMOTE
the objects in the citizens memory as good.
The demands in this document are mostly the anthisis of what America is and what the People who founded it wanted.
